Why Donald Trump Is Never Going to Jail

For all the hope that the events of January 6, 2021 might lead to the prosecution of Donald Trump and his high-level henchmen, I suggest you don't count on it.

Not only has the Justice Department not said a word but it doesn't appear that a grand jury is convened anywhere to hand out indictments. Further, there is no evidence that any U.S. attorney in the country has an open investigation -- this according to former U.S. attorneys. And the department is reportedly feeding information to the House special committee -- which it wouldn't do if had an active investigation. And everything the committee has said so far is in the public record, reported in newspapers and books already or text messages that prove, well, not much.

Even Pete Williams, the venerable NBC correspondent at Justice has said when asked of a criminal investigation: "I don't think so." We can go into what this all means about democracy, which is tragic, but this reminds me of the old saw: "The absence of evidence is not the same as the evidence of absence." And what the Biden DOJ has delivered at this crucible of democracy is the latter.
